The former President of the International Court of Justice presented the keynote address at a recent UN-sponsored diplomatic roundtable in Geneva. In his address, Judge Mohammed Bedjaoui reiterated the rationale behind the Court’s historic, unanimous 1996 decision that the threat or use of nuclear weapons generally constitutes a violation of international law. Judge Bedjaoui’s November 13, 2008, roundtable presentation is indispensable reading. Invoking the legal “obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control,” it serves as an effective summation of the decision the Court has made concerning nuclear weapons and the logic behind that decision. It also provides a framework for the future, outlining methods to institute this decision on a binding basis through a Nuclear Weapons Convention.
